Personal Injury Claim vs. a Workers' Compensation Claim

In California, as in most states, if one is injured while at work (and in some cases while on the way to work; or while away from work but on work related travel) the injured person's sole remedy is to file a claim for workers' compensation benefits. There are certain exceptions, but this is the general rule.

 

In some cases, the client has both a workers' compensation claim and a personal injury claim arising out of the same incident. This is why you need an attorney who is experienced in both workers' compensation and personal injury law. Not all personal injury attorneys have experience in workers' compensation and not all workers' compensation attorneys have experience in personal injury claims.
